Terms of Service

These terms govern your use of E-Swatch. By using the service you agree to them.

1. The service

E-Swatch is a web-based analog clock with a built-in scheduler. The free tier includes the core clock, four themes (one fully usable), sweep and tick modes, and up to five local schedules. The paid “Pro” tier adds extra themes, a custom-theme editor, additional marker styles, cloud-synced schedules, and a public clock link.

The service is provided “as is”. We aim for high availability but do not guarantee uninterrupted access.

2. Eligibility

You must be at least 13 years old to use E-Swatch. If you are using Pro on behalf of an organization, you represent that you have authority to bind that organization to these terms.

3. Accounts

You sign in with Google. You are responsible for activity that occurs under your account. Notify us immediately at the address below if you believe your account has been compromised. We are not liable for losses caused by unauthorized account use that you fail to report.

You may delete your account at any time by emailing us. Deletion removes your account record and saved schedules. Purchase records are retained for tax and accounting purposes as described in the Privacy Policy.

4. Subscriptions and billing

Pro is sold as a recurring subscription: $2 per month or $19 per year. Prices are in U.S. dollars and may be shown in your local currency by Creem at checkout.

Payment is processed by Creem, which acts as the Merchant of Record. This means Creem (not us) is responsible for collecting and remitting applicable sales tax, VAT, and GST. By purchasing you also agree to Creem’s terms.

Your subscription auto-renews at the end of each billing period unless you cancel. You can cancel at any time from the customer portal link Creem emails you, or by contacting us. Cancellation stops future charges; you keep Pro access until the end of the period you have already paid for.

If a payment fails, we may suspend Pro features until payment is resolved. After 30 days of non-payment, the subscription is treated as cancelled.

5. Refunds

Because Pro is a digital service that you can use immediately after purchase, we generally do not offer refunds once the billing period has started. We may, at our sole discretion, issue a refund or credit if:

• A duplicate charge occurred
• The service was unavailable for a significant portion of your billing period due to our fault
• Required by applicable law

6. License to use E-Swatch

We grant you a personal, non-exclusive, non-transferable, revocable license to use E-Swatch for personal or internal business purposes. You may not:

• Resell, sublicense, or commercially redistribute the service
• Reverse-engineer, decompile, or attempt to extract source code
• Use the service to build a competing product
• Use the public clock link feature to host content that is unlawful, infringing, or harmful

7. Acceptable use

You agree not to:

• Abuse the scheduling or notification features (for example, by using them to send unsolicited messages)
• Attempt to disrupt the service or other users’ use of it
• Use the public clock link to display content that is illegal, infringing, defamatory, or that targets harassment
• Use automated means to access the service beyond normal browser usage

8. Intellectual property

The E-Swatch name, logo, design, and code are owned by us and protected by copyright and trademark law. You retain ownership of any content you create (such as your custom theme colors or schedule labels).

9. Third-party services

E-Swatch relies on third parties for sign-in (Google), payment (Creem), and hosting (Cloudflare). Their availability and terms affect the service. We are not liable for outages or policy changes caused by these providers.

10. Disclaimers and limitation of liability

To the maximum extent permitted by law, the service is provided “as is” and “as available”, without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the service will be uninterrupted, error-free, or that alarms and scheduled actions will fire at exact times. Browser background-throttling, device sleep, and notification permission denial can delay or suppress scheduled actions.

To the maximum extent permitted by law, our total liability for any claim arising from or related to the service is limited to the amount you paid us in the 12 months before the claim, or USD $100, whichever is greater. We are not liable for indirect, incidental, special, consequential, or punitive damages.

11. Termination

We may suspend or terminate your access if you breach these terms, if your payment cannot be processed, or if we are required to do so by law. Where reasonable, we will give you advance notice and an opportunity to fix the issue.

You may stop using the service at any time. Sections that by their nature should survive termination (including but not limited to intellectual property, disclaimers, limitation of liability, and dispute resolution) will survive.

12. Changes to these terms

We may update these terms. Material changes will be posted on this page with a new “Last updated” date. For significant changes that affect your existing subscription, we will, where reasonable, notify you by email before the change takes effect.

13. Governing law

These terms are governed by the laws of the jurisdiction in which E-Swatch is operated, without regard to conflict-of-laws principles. Any dispute will be resolved in the competent courts of that jurisdiction, unless applicable consumer law provides otherwise.
